General Terms and Conditions of Huber Gold Switzerland KLG

Art. 1 – Scope and Provider

These General Terms and Conditions govern the contractual relationship between

hereinafter referred to as “Huber Gold Switzerland”, and its customers.

These General Terms and Conditions apply to orders placed through the online shop at www.hubergold.ch as well as to orders based on written quotations, order confirmations or price lists issued by Huber Gold Switzerland.

They apply to both private and business customers. For individually agreed orders, the provisions of the respective quotation or order confirmation take precedence over these General Terms and Conditions.

Any terms and conditions of the customer that differ from these General Terms and Conditions apply only if Huber Gold Switzerland has expressly accepted them in writing.

Art. 2 – Offer and Conclusion of Contract

The presentation of products in the online shop, in catalogues or in price lists does not constitute a binding offer by Huber Gold Switzerland, but an invitation to the customer to place an order.

By submitting an order, the customer makes a binding offer to purchase. The automatically generated order confirmation merely acknowledges receipt of the order and does not constitute acceptance of the offer.

The purchase contract is concluded when Huber Gold Switzerland expressly confirms the order or hands the ordered goods over for dispatch.

For bespoke items, personalised products, wholesale orders and other special orders, the contract is concluded upon written order confirmation by Huber Gold Switzerland.

Huber Gold Switzerland may reject an order, in particular where a product is unavailable, an obvious pricing or product error has occurred, customer information is incomplete or there are reasonable grounds to suspect misuse. Any payments already made will be refunded in such cases.

Art. 3 – Products and Product Presentation

Huber Gold Switzerland works with rare natural products, edible gold and silver, and products that are partly made or refined by hand.

Variations in colour, shape, structure, grain size, dimensions, gold application or arrangement may result from the natural characteristics of the materials used or from the artisanal process. Such product- and material-specific variations do not constitute defects.

Product images are intended to provide the most faithful representation possible. Depending on the screen, lighting and device settings, colours and proportions may differ from the actual product.

The product description, the stated net quantity or number of pieces, and any characteristics expressly confirmed in writing are decisive.

Food products must be stored and used in accordance with the information on the packaging. The customer is responsible for observing the product, ingredient and usage information before use.

Art. 4 – Prices and Shipping Costs

All prices are stated in Swiss francs and include any legally applicable value added tax unless otherwise indicated.

Shipping costs are shown separately and displayed to the customer before the order is completed.

The price displayed at the time of the order, or the price agreed in an individual quotation, is decisive.

Huber Gold Switzerland is not bound by obvious pricing, typographical or calculation errors. In such cases, the customer will be informed and may confirm the order at the corrected price or cancel it.

For individually agreed international deliveries, the customer bears any customs duties, import taxes, levies and fees unless otherwise agreed in the quotation.

Art. 5 – Payment

The payment methods stated in the online shop or in the respective quotation are available.

For orders placed through the online shop, the purchase price is generally due immediately upon placing the order. Huber Gold Switzerland is not obliged to dispatch goods before payment has been received in full.

Where payment by invoice has been agreed, the payment term stated on the invoice applies.

If the customer is in default, Huber Gold Switzerland may charge default interest of 5 per cent per year and a reminder fee of CHF 20 for each reminder. Any further collection and debt-enforcement costs actually incurred remain reserved.

Art. 6 – Availability

The availability of certain salts, crystals, gold products and handcrafted items may be limited by natural scarcity or restricted production capacity.

If an ordered item cannot be supplied, or cannot be supplied in the quantity ordered, Huber Gold Switzerland will inform the customer. Any payments already made for unavailable goods will be refunded.

There is no entitlement to the reproduction or renewed availability of a limited or naturally rare product.

Art. 7 – Delivery

Delivery is generally made to addresses within Switzerland. Deliveries to other countries are made only where this is provided for in the online shop or has been agreed individually in writing.

The usual processing and delivery time is generally three to seven working days. Delivery-time information is indicative and does not constitute a guaranteed date unless a binding delivery date has been expressly agreed.

For bespoke items, personalised products and special orders, the delivery times stated in the quotation or order confirmation apply.

Delays caused by force majeure, official measures, operational disruptions, shortages of materials, customs clearance, strikes or other events beyond the control of Huber Gold Switzerland extend the delivery period accordingly.

The customer is responsible for providing a complete and correct delivery address. Additional costs resulting from an incorrect address, an uncollected parcel or a repeated delivery attempt may be charged to the customer.

The risk of accidental loss of or damage to the goods passes to the customer upon delivery. If the customer authorises the carrier to leave the parcel in a designated place, the risk passes once the parcel has been properly deposited at the agreed location.

Art. 8 – Inspection and Complaints

The customer must inspect the delivery immediately upon receipt for completeness, accuracy and visible damage.

Incorrect deliveries, missing items, damage in transit and other visible defects must be reported to Huber Gold Switzerland within five working days of receipt by email to info@hubergold.ch.

Hidden defects must be reported within five working days of their discovery.

The complaint must include a description of the defect and suitable photographs of the product and, where relevant, the shipping packaging. The goods and packaging must be retained until the matter has been resolved.

If a complaint is submitted late, the goods are deemed accepted unless mandatory statutory provisions provide otherwise.

Art. 9 – Warranty

Huber Gold Switzerland warrants that the delivered goods possess the agreed characteristics at the time of delivery.

The following, in particular, do not constitute defects:

•    natural variations in the colour, structure, transparency or grain size of salts and crystals;
•    minor variations resulting from artisanal production;
•    technical differences between product images and actual colours;
•    damage caused by improper storage, use or handling;
•    damage to delicate gold or silver products after opening or as a result of improper removal;
•    normal wear and tear of tools and accessories.

Where a complaint is made in due time and is justified, Huber Gold Switzerland will, at its discretion, provide a replacement, remedy the defect, reduce the price or refund the purchase price of the affected item.

Further warranty claims are excluded to the extent permitted by law. Mandatory statutory claims and liability for fraudulently concealed defects remain reserved.

Art. 10 – Returns and Exchanges

Under Swiss law, there is no general statutory right to cancel or return an online order. Huber Gold Switzerland therefore does not grant a general right to return or exchange goods that are free from defects.

A voluntary return may be accepted in individual cases and only with the prior written approval of Huber Gold Switzerland. There is no entitlement to such approval.

The following are excluded from voluntary return in particular:

•    food products;
•    edible gold and edible silver;
•    opened or unsealed products;
•    personalised or custom-made products;
•    special orders;
•    products made or gilded to order;
•    products that cannot be resold for hygiene reasons.

The customer’s rights in relation to defective, damaged or incorrectly delivered goods remain unaffected.

Unauthorised returns may be refused. Unless otherwise agreed, the customer bears the cost of any voluntarily approved return.

Art. 11 – Bespoke Items and Business-Customer Orders

For bespoke items, personalised products, individual packaging, labels, gift sets and business-customer orders, the specifications confirmed in writing are decisive.

Designs, texts, names, logos, quantities and versions approved by the customer are binding. The customer is responsible for ensuring that the content and marks supplied by the customer may lawfully be used and do not infringe any third-party rights.

Once the contract has been concluded or procurement or production has begun, an order may be changed or cancelled only with the written approval of Huber Gold Switzerland.

Work already performed, materials procured, customer-specific components produced and any other costs incurred must be paid by the customer.

Minor variations from samples, designs or previous productions resulting from artisanal processes or the nature of the materials do not constitute defects.

Art. 12 – Liability

Huber Gold Switzerland is liable for damage that it has caused intentionally or through gross negligence.

Liability for slight negligence and for indirect damage, consequential damage, loss of profit, loss of revenue, loss of data or third-party claims is excluded to the extent permitted by law.

Liability for auxiliary persons and engaged service providers is excluded to the extent permitted by law.

Mandatory statutory liability provisions, in particular those relating to personal injury, product liability and damage caused intentionally or through gross negligence, remain unaffected.

Huber Gold Switzerland is not liable for delays or damage caused by shipping providers, customs authorities, force majeure or other events beyond its control unless mandatory statutory liability applies.

Art. 13 – Copyright and Intellectual Property

All website content, including in particular texts, photographs, graphics, product designs, names, logos and forms of presentation, is the property of Huber Gold Switzerland or is used with the consent of the respective rights holders.

Reproduction, adaptation, publication or commercial use is not permitted without the prior written consent of Huber Gold Switzerland.

Art. 14 – Data Protection

The processing of personal data is governed by the Privacy Policy published on the website.

Personal data may be disclosed to the service providers required for the technical operation of the online shop, payment processing and shipping.

Art. 15 – Governing Law and Jurisdiction

All legal relationships between Huber Gold Switzerland and the customer are governed exclusively by substantive Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

To the extent permitted by law, the courts at the registered office of Huber Gold Switzerland KLG have jurisdiction over all disputes.

Mandatory statutory places of jurisdiction, in particular those protecting consumers, remain unaffected.

Art. 16 – Language Versions

These General Terms and Conditions may be published in several languages.

In the event of differences or inconsistencies between the language versions, the German version prevails unless mandatory statutory provisions provide otherwise.

Art. 17 – Amendments and Severability

The version of these General Terms and Conditions published at the time the contract is concluded applies to the respective order.

Huber Gold Switzerland may amend these General Terms and Conditions at any time for future orders.

If any provision of these General Terms and Conditions is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions remains unaffected.
